Concerns about understanding between Chisinau and Tiraspol over criminal cases
A resident of the Transnistrian region, Ala Gherman, who said that she represents a number of persons who suffered because of the separatist Transnistrian region, is categorically against an understanding between Chisinau and Tiraspol as regards the exchange of data about the criminal cases started against persons holding responsible positions. She considers that the Transnistrian regime aims thus to find out who is against it and the persecutions will continue at a more intense rate.
In a news conference at IPN, Ala Gherman said that her brother has been illegally held in a prison in Transnistrian for two years. She considers that the authorities must first of all examine the cases opened against ordinary people. “Next week, Prime Minister Iurie Leanca will meet the Transnistrian leader Yevgeny Shevchuk in Tiraspol. I suggest that they begin discussing the criminal cases against ordinary people who are held illegally,” stated the woman.
Promo-LEX program director Pavel Postica said the association is concerned about the fact that the constitutional authorities will exchange personal data with the Transnistrian administration. He considers that the Transnistrian regime wants to know who filed complaints against it or its representatives.
The Moldovan legislation bans the working out of a special mechanism for examining criminal cases started by Chisinau or Tiraspol. A number of Moldovan courts of law pronounced on the issue, saying any exchange of personal information between the constitutional authorities and the unrecognized ones is illegal, said Pavel Postica. According to the statistics of Promo-LEX, the Bender Commissariat in 2004-2011 opened 41 criminal cases against Transnistrian officials.
Promo-LEX calls on the law enforcement bodies not to blindly implement a political decision, but to obey the law. Pavel Postica considers that the decision was taken because the Moldova authorities want to show that they achieved results in the process of bringing the two banks of the Nistru closer.
On September 16, the political representatives to the Transnistrian settlement Eugen Carpov and Nina Shtansky signed an agreement providing that the working groups will step up work on the criminal cases started against decision makers of Chisinau and Tiraspol.

Report: judicial reform process is very slow
Implementation measures of the Justice Sector Reform Strategy is very slow. This is one of the conclusions of monitoring report of the implementation of that strategy, developed by the Promo-LEX Association for Effective and Responsible Governance (AGER).
“Of the total of 101 remained actions for the period of 2012 and first quarter of 2013, only 44 were completed , which is 43%. Thus, we can affirm that the implementation of the Action Plan on Justice Sector Reform Strategy is proceeding very slowly. With regard to the actions that were to be implemented in the second quarter of 2013, the situation is even worse. Of 31 actions were carried out only 6, or 19%, “explained Olesea Stamate, director of the AGER.
According to Pavel Postica, program director at Promo-LEX, a positive trend has been recorded on the monitoring component of hearings and the quality of the judiciary. “If we talk about certain trends, compared with the first report with positive title, we can say that if in the first quarter of the total monitored only 77 meetings were held in the meeting rooms, then in the second quarter this figure increased almost three times. So, we recorded an increase of about 12% in terms of the audio recording of court proceedings. If in the first quarter there were only 145, or a little under 50%, at this time, the figure increased to 179 from 300 monitored cases, “said Postica.
The main recommendations included in the report refer to the need of strengthening the institution of the Working Group, supplementing the regulation on the functioning of the working groups with provisions that would require the secretariat of these groups to publish minutes of meetings, agendas, and other products including correspondence on website of the Ministry of Justice, within a reasonable time of their conduct.
