Promo-LEX suggests penalizing persons who support separatist regime

Chisinau can penalize the person who support the Transnistrian separatist regime, forcing them thus to observe the rights of the Moldovans in the region. Such a proposal was submitted by the lawyer of the nongovernmental association Promo-LEX Pavel Postica.

In a news conference at IPN, the lawyer said the Moldovan authorities have the leverage needed to question and even punish the persons who violate the human rights in the Transnistrian region, but they prefer not to become involved. As a result, more and more persons are affected. The Transnistrian regime confiscates their possessions and businesses.

The economic penalties can force Tiraspol to act as the Chisinau requests, considers Pavel Postica. The lawyer said that no radical measures, like the military ones, are required, but more effort should be made to protect the citizens. According to him, international monitoring in the region will be welcome.

Pavel Postica stated that it will be soon a year since Promo-LEX submitted a list of 40 people who violate the rights of Moldovans in Transnistria to the Prosecutor General’s Office (PGO). The prosecutors can question these persons as they either live on the right bank of the Nistru River or have businesses here. Promo-LEX received yet no answer from the PGO over this list.

Council of Europe’s Ministers to discuss ignored decision of ECHR over Romanian-language schools in Transnistria

 

The problem of non conformance with the ECHR decision on the Romanian-language schools in the Transnistrian region will be examined by the Committee of Ministers of the Council of Europe on March 4-6, 2014. A decision in this case was announced by the Grand Chamber of the ECtHR on October 19, 2012. The High Court recognized the violation of the right to education admitted by the Russian Federation. The court ruled that plaintiffs be given by way of moral damages, 1 million and 20 thousand euros and 50,000 euros for costs of representation.
“Although we have a European Court’s ruling that establishes clear violation of the right to education in Transnistria, High School students and teachers of “Stefan cel Mare” in Grigoriopol continue to travel the 80 km to be able to study in their mother tongue. At the same time, other educational institutions are subject to systematic intimidations from the illegal administration of Tiraspol,” said Ion Manole, executive director of “Promo-LEX”.

Previously, the CoE Committee of Ministers adopted a declaration calling on the Russian authorities to provide relevant information quickly, in the form of an action plan and report on the execution of this case. It has led to increased pressures from the illegal local authorities on the Romanian high schools in the region’s.

Expert: OSCE’s attitude on human rights in Transnistria – a big mistake

The failure of the constitutional authorities from Chisinau to act in situations when human rights are violated in the self-governed region of Transnistria and the lack of sanctions have “encouraged the phenomenon of impunity, gave the perpetrators a sense of absence of punishment for any clearly illegal deed, committed knowingly and repeatedly by various people,” says Ion Manole, the head of Promo-LEX Association, in an interview for Epoch Times, quoted in the Promo-LEX newsletter.

The expert argues that the individuals who took control over the left bank of the Nistru River “are simple executors, so this is not really up to them.”

Mr. Manole claims that the OSCE “made a big mistake when they adopted a passive approach towards this situation and the state of human rights in the region.”

Transnistrian separatist authorities recently called on constitutional authorities in Chisinau to withdraw within one month its security forces from the Security Zone. Moreover, a Romanian language school principal from Tiraspol was arrested for eight hours for allegedly smuggling currency. Teachers and children are continuously harassed and people randomly detained and imprisoned on fabricated cases.

European Parliament issued a non-legislative statement, condemning the pressure exerted upon the Romanian language schools in Transnistria. The resolution called on the illegitimate authorities to ensure the right to education in the region.
